Bhopal, On the petition of Dr. Govind Singh, Leader of the Opposition in Madhya Pradesh Legislative Assembly, the Supreme Court has agreed to consider the provision of summoning any accused of ED and taking statement. He has given notice to the Central Government and ED and sought answers. This is considered to be an important step of the Supreme Court regarding the provisions of the Prevention of Money Laundering Act (PMLA).

On the petition of Dr. Singh, the Supreme Court has issued a notice on the provision of summoning of ED under the PMLA Act. A bench of Justice SK Kaul, Justice Ahsanuddin Amanullah and Justice Arvind Kumar has issued a notice seeking a reply. The petition challenges the constitutionality of sections 50 and 63 of the PMLA. The petition has also sought quashing of the summons issued by the ED to Dr. Govind Singh on January 13. The petition states that the Supreme Court judgment upholding the provisions of the PMLA should be reviewed and the matter be referred to a larger constitutional bench, as the provision violates the fundamental rights of the people. According to the information, Section 50 of PMLA provides for ED officers to issue summons to anyone for statement and record the statement in front of the officers. Such statements are admissible in court. On 27 July 2022, the process of arrest, seizure and investigation carried out by the Enforcement Directorate (ED) under the Prevention of Money Laundering Act (PMLA) was upheld. The Supreme Court gave the SC verdict on 242 petitions, including Karti Chidambaram, son of former Union Minister P Chidambaram, and Anil Deshmukh, former minister of Maharashtra government. This decision was given by the bench of Justice AM Khanwilkar, Justice Dinesh Maheshwari and CT Ravi Kumar.
