Now that the Supreme Court has ordered to hand over the responsibility of transfer of administrative officers to the Delhi government, speculations were rife that this war between the two would come to an end.

There are three centers in Delhi’s power. First LG, second Delhi Government and third Delhi Municipal Corporation. The root cause behind the tussle between the LG and the Delhi government pertains to the division of powers between the three centers of power. If the same party is in power in these three centers of power in Delhi i.e. the same party is in power in the Government of India, Government of Delhi and Delhi MCD, then the chances of conflict are reduced. But, if different parties like BJP and Aam Aadmi Party are in the central government, Delhi government and MCD, then the conflict intensifies. In the last 8 years, there has been increasing tension between the LG office and the Delhi government regarding the distribution of powers. After Kejriwal became the Chief Minister, the Delhi government’s relations with the Lt Governor’s office have never been good. The court said that the Parliament also has rights in the affairs of Delhi. Delhi did not get full statehood, so a balance has to be struck from the Centre.

The Aam Aadmi Party has raised the demand that Delhi should get full statehood. Ever since CM Arvind Kejriwal came to power, he has raised this demand prominently in political meetings as well. According to the order of the Supreme Court, the transfer of administrative officers will be under the control of the Delhi government. Not only will he be able to appoint officers in administrative departments as per his wish, but also if the government feels that any officer is not working, he will be able to remove him. Similarly, now the officers will report to the concerned ministers instead of the Lieutenant Governor. The Delhi government will also write a confidential report on the work of these officers. The central government said that the situation has changed with the amendment made in the Government of NCT of Delhi Act. Delhi is the national capital. The government here cannot be given rights like the government of a full state. The central government also said that the Delhi government wants to maintain a state of controversy continuously to do politics. A five-judge constitution bench comprising CJI DY Chandrachud and Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha delivered the majority verdict on the ongoing dispute between the Delhi government and the Centre. After the decision on this controversial issue, it became clear that the Delhi government will control the administrative services regarding transfers and postings of officers.

This decision will be important for the Delhi Government because now the interference of the Lieutenant Governor in the work of the Delhi Government will be very limited. The government will be able to deploy officers matching with its thinking in the important departments of the government such as finance, law and public works etc. and through them it will be able to implement its plans faster. Also, after this victory, the Aam Aadmi Party has also found a way to prominently raise the demand for full statehood for Delhi.
