Allahabad High Court has given a big decision. The High Court has made it clear that if physical relationship is established during love affair, then it will not be called rape. The court also said that even if marriage was denied for some reason, physical relationship would still not fall in the category of rape. With this comment, the High Court has canceled the criminal proceedings going on in the lower court against the lover accused of rape. At the same time, the petition challenging the charge sheet filed in the lower court on behalf of accused Ziaullah has also been accepted. This order has been given by the single bench of Justice Anish Kumar Gupta.

According to media reports, a girl lodged a complaint in the women’s police station of Sant Kabir Nagar saying that she was raped during love. She said that she met her lover during her sister’s wedding in 2008. The closeness between the two grew and they started having physical relations. The girl alleged that later her boyfriend’s family sent her to Dubai for business purposes. When he returned from Dubai, she refused to marry him. The girlfriend had filed a rape case regarding this.
Charge sheet filed against Ziaullah canceled
In this case, the petitioner’s lawyer said that the girl was an adult when the two had a relationship. It is clear that they entered into a relationship of their own free will. This is the reason why a false case has been filed for refusing to marry. The court heard both the parties and ruled that physical relations formed during love affair would not be called rape. Along with this, the court has canceled the police charge sheet filed against Ziaullah.
