Hearing on Mob Lynching: Supreme Court asked- What about Kanhaiya Lal, the tailor of Udaipur who was murdered in public?

Mob Lynching Cases: These days a Public Interest Litigation (PIL) is being heard in the Supreme Court, in which a demand has been made to issue an order regarding the incidents of mob lynching against minorities. Those who filed the PIL include families of people who were beaten to death by alleged cow vigilantes. Who have demanded immediate financial relief from the apex court. On Tuesday, during the hearing on mob lynching, the court mentioned the Kanhaiyalal murder case of Udaipur and asked the petitioner’s lawyers not to be selective while presenting such cases.

The hearing is being held in the bench of three judges of the Supreme Court.
In June 2022, tailor Kanhaiyalal was murdered in broad daylight by assailants who entered his shop in Udaipur, Rajasthan. During the investigation, the angle of Muslim fundamentalism came to light in the case. The Supreme Court bench comprising Justice BR Gavai, Justice Arvind Kumar and Justice Sandeep Mehta heard the petition related to increasing mob lynching against minorities. The court asked- What about the tailor from Rajasthan… Kanhaiya Lal… who was beaten to death?

On this, the petitioners’ lawyer Nizam Pasha admitted that it was not mentioned and said that the large-scale increase in mob lynching has been the reason for the exclusionary attitude of the minorities. The court said- When all the states are present then you cannot be selective. Kanhaiya Lal was brutally murdered for sharing a social media post in support of former BJP spokesperson Nupur Sharma, who had commented about Prophet Mohammed.

Gujarat government’s lawyer said in the case that the PIL is mainly highlighting the lynching of Muslims only. Senior lawyer Archana Pathak Dave said- This is just mob lynching of Muslims. How can it be selective? State governments have to protect people of all communities.

On this the Supreme Court said – Yes, you should keep in mind that it should not be selective at all, if all the states are involved in it. Then lawyer Pasha said- Only Muslims are being beaten to death. This is a factual statement."

Then Justice Gavai replied – Please be serious in whatever you are presenting in the court. After this, the Supreme Court postponed the hearing till after the summer vacation, which runs from 20 May to 7 July.
