Election Commission’s reply in Delhi HC in the name of INDIA alliance, said- we cannot do anything

INDIA Name: The Election Commission of India has filed an affidavit in the Delhi High Court in response to a petition by a coalition of 26 opposition political parties against the use of the name India. The Election Commission said that it does not have the authority to regulate political alliances. Also said that it is mandatory for political parties to be registered under the law, and not political alliances can be registered.

The Election Commission said that in terms of Section 29A of the Representation of the People Act 1951, the right to register bodies or associations of persons of a political party has been given. Political alliances are not recognized as regulated entities under the Representation of the People Act. On August 4, a bench of Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula had asked the Centre, ECI and 26 opposition parties to respond to the petition.

The Election Commission also cited the decision of the Kerala High Court in the case of Dr. George Joseph vs. Union of India (2021), in which the Court had declared the names of LDF (Left Democratic Front), UDF (United Democratic Front) and National Democratic Alliance (NDA) Had refused to give instructions. The court had said that political alliances are not legal entities under the RP Act.

The businessman had filed a petition

The Election Commission had given its reply on a PIL filed by a businessman named Girish Bhardwaj. In his petition, Bhardwaj argued that it is an essential part of the national emblem for political purposes. This is in violation of the Indian Use of Marks and Names (Prevention of Improper Use) Act, 1950. Expressing concern, he said that this could have a significant impact on peaceful, transparent and fair voting during the Lok Sabha elections in 2024. Due to this, the law and order of the country can also be affected.
