Shaista Parveen will be in double trouble by surrendering, read the rules

Atiq Ahmed’s wife Shaista Parveen can surrender in court today.

Atiq Ahmed’s wife Shaista Parveen can surrender in court today.

Shaista Parveen, wife of mafia Atique Ahmed, is absconding after the Umesh Pal murder. UP Police has declared a reward of Rs 50,000 on him. Even after this, he is far away from the clutches of the police. According to media reports, Shaista Parveen can surrender in the court today. Police has issued an alert in all the districts. The police team is raiding different locations in search of Shaista Parveen. The phones of all the close relatives of Atiq Ahmed and Shaista Parveen have been taken under surveillance. Village-to-village search operation is going on.

Along with the UP Police, the UP STF has also conducted a search operation, but nothing has been found about Shaista yet. Apart from Kareli, Kasari-Masari in UP, Atiq’s relatives live in Dhoomanganj, Puramufti, Kokhraj, all the villages where Shaista Parveen is suspected to be hiding. On Thursday also a police team had launched a search operation, but it was not found anywhere.

What does the law say on surrender

Atiq Ahmed’s wife Shaista Parveen can surrender in the court today, with this it remains to be seen what the law of India says on the rules of surrender. Advocate Sunil Kumar Bakshi has given two reasons behind the surrender. He submits that surrender means that the appellant has accepted his crime. In such cases, the court decides whether to send the accused on remand or not. Shaista Parveen is involved in a serious crime. In such a situation, even if she surrenders in the court, she will not be able to escape from the interrogation of the police. The police can apply for remand for Shaista in the court. The court decides on whether this application will be accepted or rejected. However, in serious cases this application is accepted, so Shaista’s trap is certain.

Anticipatory bail appeal may also be heavy

Another reason is that if a person is in fear of arrest for some offence, he can apply for anticipatory bail. On getting anticipatory bail, the accused will cooperate with the police investigation, but he cannot be directly arrested till the anticipatory bail period is over. Since an application has to be made in the court even for anticipatory bail, this is also not possible for Shaista.

Explain that while considering anticipatory bail, the court takes into account the nature and seriousness of the allegation, the full account of the accused, the possibility of the applicant running away and whether the allegation is true or false. In such a situation, the difficulties of Shaista Parveen are going to increase even more.
