CG NEWS: Fine of Rs 85 lakh for negligence in giving information, action against public information officers

Raipur. Chhattisgarh State Information Commission Commissioner Dhanvendra Jaiswal has registered a total of 3 thousand 836 cases in the last two and a half years for negligence in providing timely information to the applicants and not proper implementation of the Right to Information Act. A fine of more than Rs 85 lakh 37 thousand has been imposed on the concerned public information officers. The State Information Commissioner’s court has imposed this fine in the order passed from March 2021 to September this year.

The Right to Information Act came into force in the country from 12 October 2005. Under this, common people can get information from government offices and offices of adequately funded NGOs. Under the Act, Public Information Officers have to provide information to the applicants within 30 days. If he fails to give the information or is negligent in giving the information, then a hearing is held against him before the first appellate officer, where the application is resolved within 30 days or maximum 45 days. Even at this stage, when the applicant does not get the information or gets incomplete information, then a second appeal or complaint is made to the Chhattisgarh State Information Commission. There, the applications are disposed of in a quasi-judicial manner under the provisions of the State Information Commissioners Act and disciplinary action is recommended against the first appellate officers along with imposition of fine on the defaulting Public Information Officers.

The public information officers against whom action has been taken include Joint Collector, Tehsildar, CEO District Panchayat, Block Education Officer, Mineral Officer, Women and Child Development Officer, Public Information Officer of Medical College and Secretary of Gram Panchayats and others. Similarly, disciplinary action is also being recommended by the Commission against the first appellate officers.

Naya Raipur-based Chhattisgarh State Information Commission has made online arrangements for hearing of second appeals and complaints under the Right to Information Act. Appellants can apply online as well as offline. The hearing is conducted from the video conferencing room of NIC located in the collector office of all the districts.
