Even today, catch marriage is conducted in Bihar.

Pakadwa Marriage in Bihar: In Vaishali, the discussion on forced marriage has intensified after a teacher selected from BPSC was kidnapped and forcibly married. Many people are calling forced marriage as bullying on the part of the girl’s family, while some people are calling such marriage a compulsion on the part of the girl’s family. The special thing is that the cases of Pakdaua marriage come to light from Bihar only. Now the question arises whether only the girl’s parents are responsible for forced marriage or the boy’s parents can also be responsible, let us try to understand.

In India, since the time of King Maharaja, gifts were given from the bride’s side to the groom’s side. Later its name changed from ‘Uphaar’ to ‘Dowry’. The groom’s side openly started demanding dowry from the bride’s side. If she did not get dowry, she would even return to the wedding procession. Even if the marriage took place on the assurance of the bride’s side, the girl was not allowed to enter her in-laws’ house until the full dowry was received. Not only this, even after all the demands were fulfilled, if the woman reached her in-laws, the torture on her continued so that she could bring more dowry. A law was made in India in 1961 against this social evil. Under this law, taking and giving dowry was categorized as a crime. It is said that the foundation of captive marriage was laid only after this law came into existence.

How was the foundation of Pakdaua marriage laid?

Media reports suggest that the foundation of Pakdaua marriage was laid in Bihar in the 60s. Those who could not pay dowry would forcibly abduct the boy and get him married. In the initial phase of forced marriage, most of the cases were reported from the areas around the Ganga belt of Bihar. At that time people believed that if seven rounds were made then it would mean that the relationship of seven births has been tied. In such circumstances people did not go to the police. If we went to the police, there was a fear that we might get caught in the dowry law. For this reason, cases of forced marriage started appearing rapidly. However, with changing times, people became aware that forced marriage is not acceptable, so the victims started raising their voice against forced marriage. But the case from Vaishali has made it clear that even today, forced marriage has not been curbed.

Who is responsible for arranged marriage

After reading the news till now, you might have felt that the girl’s family is responsible for arranged marriage, but it would be too early to give a complete clean chit to the groom’s side. In fact, like the bride’s side, the groom’s side can also be responsible for a caught marriage. In a report, Suman (fictitious name), wife of Pawan (fictitious name), a loco pilot working in the Railways, said that her in-laws had demanded Rs 10 lakh in dowry. Had given Rs 5 lakh, but still started delaying the engagement. Suman comes to know from Pawan that her mother has fixed the relationship somewhere else and will give dowry of Rs 12 lakh. Suman told that Pawan had fallen in love with her, so she married him without his consent. Suman told that today she goes to their house, but from time to time she is taunted about dowry. Not only this, now Pawan also hurts in every fight by saying that if I had married as per the wishes of the family, the family would have been happy and so would I. Till date Suman has not been able to understand the meaning of ‘I would also be happy’.

Instead of bullying, take help of law

Abhinav Sharma, a lawyer of a private company in Noida, said that forced marriage is not valid as per the law. If the groom’s side demands dowry and backs out of the marriage, the bride’s side can file a complaint with the police. At the same time, if the girl’s side forcibly abducts a boy and gets him married, a complaint should be lodged with the police immediately. He said that both taking and giving dowry are in the category of crime. Not only the dowry taker but the dowry giver is also guilty in the eyes of the law, in such a situation the victim should fight a legal battle instead of panicking.
