Supreme Court Ban to Green Firecrackers: The Supreme Court refused to interfere with the Arvind Kejriwal-led Aam Aadmi Party (AAP) government’s decision to ban the use of firecrackers in Delhi ahead of the Diwali festival. The court also reiterated that barium cannot be allowed to be used as a chemical in firecrackers. Firecracker manufacturing companies had demanded this from the court. The court said that in states where firecrackers are not completely banned, green firecrackers can be burnt.

Supreme Court bans production and sale

The Supreme Court had earlier asked the Delhi Police not to issue temporary licenses for the sale and storage of any kind of firecrackers and said that when the city government has banned all firecrackers, no one should be allowed to do so on this basis. Cannot distinguish whether they are green or not. One of these petitions was filed by Bharatiya Janata Party leader Manoj Tiwari challenging the complete ban on firecrackers during Diwali celebrations in Delhi in 2022.

During the hearing, Additional Solicitor General Aishwarya Bhati, appearing for the government, had told the court that it is true that barium was banned on the government’s proposal, but it was for Diwali 2018. The court remarked that right now everything is banned in Delhi, be it green or otherwise.

Bhati also told the court that Delhi Police has not issued any permanent license for firecrackers since 2016. Besides, the court also said that it is not enough to punish those who burn firecrackers, rather the authorities will have to go to the source of these firecrackers.
