High Court’s Verdict: Providing 100% Women’s Reservation “Unconstitutional”"

During the hearing of a case, the High Court said that it is “unconstitutional” to provide 100 percent women’s reservation in favor of the post of Demonstrator, Professor in Government Nursing College. Let us tell you, in December 2021, the Chhattisgarh State Public Service Commission has announced the recruitment of Assistant Professor Nursing and Demonstrator. In June 2013, according to the Medical Education (Gazetted) Service Recruitment Rules, only women were considered eligible for these posts.

Challenge to Recruitment Process and Recruitment Rules 2013

In the issued advertisement also it was mentioned to recruit only women. Challenging the Recruitment Process of PSC and Recruitment Rules 2013, Alyus Khalkho of Korea, Aditya Singh through Advocates Ghanshyam Kashyap and Nelson Panna filed a petition in the High Court. During the hearing of this case, the High Court had banned recruitment in nursing colleges.

Violation of Articles 14, 15 and 16 of the Constitution

Describing it as contrary to the reservation rules, it was said in the petition that the posts for which the advertisement was issued are also studied by the competitors of the male category. But, depriving them of appointment to these posts is in violation of the reservation rules given in Articles 14, 15 and 16 of the Constitution.
