Chief Justice took suo motu cognizance on DJ noise: Hearing held in the form of PIL, final notice issued to Chief Secretary

Bilaspur. The Chief Justice himself has taken cognizance of the problems being caused by the deafening noise of DJs in Bilaspur city. Considering the seriousness of the matter, the case was heard as a public interest litigation. Referring to the earlier orders given by the Supreme Court and Chhattisgarh High Court on this subject, the court has issued a notice to the Chief Secretary and passed an interim order to submit a report regarding their compliance.

During the hearing, the double bench expressed its displeasure and asked the Chief Secretary of Chhattisgarh Government to tell, what efforts were made to eliminate the threat of noise pollution caused by DJs during festive occasions? The court has given instructions to submit a detailed affidavit in this regard. The Chief Justice has admitted that the current situation of noise pollution in Bilaspur city is bad, which is also evident from various news reports. This is nothing but a disgraceful act by responsible state officials. They have failed to make any efforts to stop the menace of noise pollution. Even after passing various orders and directions of the Supreme Court as well as this Court, the situation remains the same.

There is a danger of increasing noise pollution related diseases due to non-compliance of instructions.

On December 6, 2016, on a PIL, the High Court had ordered that Collectors and SPs will ensure that DJs do not play by placing sound boxes on any vehicle. There are instructions to confiscate the sound box if DJ is playing by placing it on the vehicles. When the sound box is found, a record of the vehicle should be maintained. If the sound box is played on the same vehicle for the second time, the permit of that vehicle should be canceled and no new permit should be issued without the order of the High Court. But the court order has not been followed till date and on many occasions in the city, DJ is being played at loud volume. Due to this, people are facing huge problems and the risk of diseases related to noise pollution is increasing.
