The Bihar government has got a big blow from the Patna High Court. The High Court on Thursday stayed the conduct of caste census in Bihar with immediate effect. A petition was filed in the High Court regarding the caste census being conducted by the Bihar government. After completing the hearing on this application, the court had reserved its decision on Wednesday. After this, the court, while giving its verdict on this on May 4, has stayed it. In the petition filed against the caste census, it was said that the jurisdiction of the census comes under the purview of the Central Government. The state government cannot conduct such a census.

It is not right to use contingency fund in census

The court accepted that the money spent by the government in conducting the caste census would be a misuse of emergency funds. The petitioner’s lawyer said that the court agreed with his argument that the decision taken by the Nitish government to conduct caste census is against the Constitution and the Census Act, 1948. The lawyer said that the Patna High Court will hear the matter next on July 3.

Earlier during the hearing on Wednesday, Advocate General PK Shahi told the High Court that a decision has been taken to conduct the caste census by passing a unanimous resolution in both the Houses. This is a policy decision of the state government. Budget provision has also been made for this and money has not been withdrawn from the contingency fund. After the completion of the hearing on the caste census, the court had reserved its decision. During the hearing, the court was told that the state government is spending Rs 500 crore for the caste census.

Caste census being done with the consent of all parties: Nitish

On the other hand, on caste-based census, CM Nitish says that this work is being done with the consensus of all political parties, but there are some people who are troubled by the caste census. Now all the castes will be counted, then all of us will be benefitted. Regarding this issue, in the year 2019 itself, it was approved by the Assembly. Nitish further said that if there is a caste census, then it will be known that how backward are the people of which caste in our society.
