Defamation Case: The Supreme Court has given a big relief to Congress leader Rahul Gandhi in the Modi surname defamation case. The court, while hearing Rahul’s petition, stayed the sentence. In such a situation, the membership of Rahul Gandhi has also been restored. The court said that till the appeal in the case is pending, the sentence is stayed. The Court observed that the ramifications of the order of the Trial Court are wide ranging. This affected not only Rahul’s right to continue in public life, but also the right of the electorate to elect him.

Rahul Gandhi’s statement was not derogatory – SC

The Court said that there is no doubt that the statements are not made in a good mood, a person in public life is expected to exercise caution while making public speeches. As this Court observed while accepting his affidavit in the contempt petition, Rahul Gandhi should have been more careful. The Supreme Court asked the Gujarat High Court that what was the need to give maximum punishment to Rahul Gandhi. This decision is very interesting. The SC further observed that the trial court had not even given reasons for awarding the maximum sentence. A parliamentary constituency has been affected by the maximum punishment, it was unnecessary.

Rahul had filed a petition to stay the conviction

Rahul Gandhi had filed a reply in the court on the previous day demanding a stay on his conviction. Advocate Abhishek Manu Singhvi has presented the side on behalf of Rahul Gandhi. Keeping his side in the court, he said that the charges against Rahul are bailable. There is no one special caste with Modi surname. People of different caste use Modi surname in their name. That’s why Rahul Gandhi should be absolved and reinstated his membership.

Advocate Abhishek Manu Singhvi further said that there is only one line in Rahul Gandhi’s 3-page speech on which the case has been registered. The real surname of complainant Purnesh Modi is not Modi, he has changed his name later. Anyway, there is no fixed class of people with Modi surname. He further said that none of the names Rahul Gandhi took in his speech, Purnesh Modi’s name is not even there. In such a situation, there is no justification for Purnesh Modi to file a defamation case. Sindhvi said that there is no such case against Rahul Gandhi, which is of crime against the society. This is not an allegation of rape or murder. The charge is simple and bailable.
