The US Court has said in its historic decision on Tuesday that Trump cannot take part in the elections to be held in America next year. However, Trump can go to the US Supreme Court against this decision.
According to media reports, the Colorado Supreme Court’s 4-3 decision has declared Trump ineligible for the upcoming election. Such a decision has rarely been given regarding any President in the American Constitution. The decision applies only to Colorado’s March 5 Republican primary. But its conclusion could affect Trump’s standing in the state for the November 5 general election. Non-partisan US election forecasters consider Colorado to be safely Democratic, meaning President Joe Biden will likely carry the state regardless of Trump’s fate. At the same time, Trump can also appeal against this decision in the US Supreme Court.
Colorado Supreme Court overturns district court’s decision
The majority of the Court believes that Trump is ineligible to hold the office of President under Section 3 of the 14th Amendment. the court wrote in its 4-3 decision. The Colorado Supreme Court has overturned a district court judge’s decision. Which found that Trump had incited an insurrection for his role in the attack on the Capitol on January 6, 2021, but said that he could not be prevented from voting because it was not clear. The purpose of this provision was to cover the presidency.
Ban imposed till January 4
If reports are to be believed, the court put its decision on hold until January 4 or until the US Supreme Court’s decision. Colorado officials say the issue should be resolved by Jan. 5, which is the deadline for the state to print its presidential primary ballots.
