Uttarakhand Uniform Civil Code: Today, Tuesday is a very important day for the BJP government led by Pushkar Singh Dhami in Uttarakhand. The government will present the Uniform Civil Code Bill in the Assembly. The cabinet had approved this bill on Sunday. If the bill is passed and the law comes into force, Uttarakhand will become the first state in the country to adopt Uniform Civil Code after independence. This law will apply equally to all religions. That is, this bill will realize the concept of one country and one law in matters like marriage, divorce, inheritance, adoption. At present Congress is angry. Congress MLAs can create ruckus in the House.

Many other BJP ruled states including Assam and Madhya Pradesh are also showing interest in bringing UCC. The Uniform Civil Code has been in force in Goa since it came under Portuguese rule.

PM Modi had said- the country will not run with two laws
In June last year, Prime Minister Narendra Modi had emphasized on Uniform Civil Code. He had said that the country cannot run on two laws. Meanwhile, on Monday, Union Law and Justice Minister Arjun Ram Meghwal said that the Uniform Civil Code is in the consultation process and is being reviewed by the Law Commission of India. ‘This is not just an issue of the Central Government, even when the Constitution was being made, the Constitution makers had discussed it.

Dhami said- many states will adopt Uttarakhand model
A five-member committee headed by retired Supreme Court Justice Ranjana Prakash Desai has prepared a draft of the UCC. The committee spoke to more than 2 lakh people from different sections to prepare the draft. In the 2022 assembly elections, BJP had promised to bring a Uniform Civil Code for Uttarakhand. Chief Minister Pushkar Singh Dhami said that many states will adopt the Uttarakhand model.

There is no difference in inheritance between son and daughter
It is proposed that both sons and daughters get equal rights in property. Even if the girl marries another religion, her property rights will remain intact. The 2005 amendment to the Hindu Succession Act 1956 already provides for already married daughters to have an equal share in their father’s property as a son.

The UCC bill also provides for equal divorce procedure and rights for men and women of every religion in the state. The Muslim Women Act, 2019, brought in by the Narendra Modi government, has already made instant triple talaq illegal. The law of maintenance after divorce will be the same for all religions.

Ban on polygamy, child marriage
This bill makes marriage registration mandatory for all religions. It also bans polygamy and child marriage, setting a common marriageable age for girls of all religions. The bill also makes it mandatory to declare live-in relationships.
