Hemant Soren does not get relief from Supreme Court: Refusal to hear case against ED on arrest, said- Why not go to High Court?

Supreme Court Directs Ex-Jharkhand CM Hemant Soren:Former Jharkhand Chief Minister Hemant Soren has suffered a major setback in the land scam case. The special bench of the Supreme Court comprising Justices Sanjeev Khanna, MM Sundaresh and Bela Trivedi has refused to grant relief. Hemant Soren’s petition against the arrest: On Friday, the Supreme Court asked the lawyer Kapil Sibal appearing on his behalf, why don’t you go to the High Court?

Kapil Sibal replied that the matter pertains to a Chief Minister who has been arrested. On this the Supreme Court argued that the court is for everyone. High Court is a constitutional court. If we allow one person we have to allow everyone.

You had earlier just challenged the summons
Kapil Sibal said that the Supreme Court has discretionary powers. This is a case where that discretion should be used. The Supreme Court replied that it was clear that he had been arrested. If you are opposing the arrest then go to the High Court. Earlier you had only challenged the summons. There is also an earlier order which states that you should approach the High Court.

Come here only if the High Court refuses
The Supreme Court said that if he refuses to be heard in the High Court, then the door of the Supreme Court is open. Hemant Soren’s arrest by ED was challenged. Hemant Soren was arrested on the night of 31 January in the land embezzlement case.

ED is misusing its power
In the petition, Hemant Soren argued that the Enforcement Directorate has misused its power. Has acted maliciously to destabilize the democratically elected State Government. Terming his arrest illegal, he said that the ED is shamelessly acting under the orders of the Central Government and wants to destabilize the democratically elected government led by the petitioner.

The Enforcement Directorate has alleged that Hemant Soren is involved in a Rs 600 crore land scam and money laundering case. He was issued 10 summons.
