Bihar Caste Census: The Nitish government (CM Nitish Kumar) of Bihar has got a big blow from the Supreme Court. Putting an interim stay on Caste Census, the Supreme Court has refused to interfere with the decision of the Patna High Court. The court has rejected the petition filed by the Bihar government. During the hearing, the Supreme Court made it clear that the decision given by the Patna High Court was correct. No change can be made in this.

Earlier, during the hearing, the Supreme Court said that the Bihar government should be present in the hearing of the Patna High Court on July 3 and present its arguments there. If the Bihar government is not satisfied with the decision of the Patna High Court, then the matter will be heard again in the Supreme Court on July 14. A bench of Supreme Court Justice AS Oka and Justice Rajesh Bindal, while giving its verdict, said that it has to be investigated whether this exercise is a census in the guise of a survey. This is not a case where we can grant you interim relief. The Supreme Court further said that the Patna High Court has adjourned the hearing of the petition to 3 July. We direct that this petition be listed on 14th July. If for any reason the hearing of the petition does not commence before the next date, we shall hear the arguments of the senior counsel for the petitioner. Earlier on Wednesday, this petition of the Bihar government was to be heard, but Justice Sanjay Karol of the Supreme Court recused himself from the hearing. He said that he had been a party in this case while being the Chief Justice in Bihar. After this, the next date of hearing was fixed on Thursday.

On May 4, the Patna High Court had given an interim stay on the petition of the Bihar government

The High Court had rejected the Bihar government’s application for early hearing on the petition challenging the ban on caste census in the state. On May 4, the Patna High Court had ordered the matter to be heard on July 3, giving an interim stay on the Bihar government’s petition.
