Rahul Gandhi Defamation Case: Congress leader Rahul Gandhi has approached the Gujarat High Court seeking a stay on his conviction in the Modi surname case. Rahul Gandhi has challenged the lower court’s order in the Gujarat High Court. Now the High Court can hear this matter on Thursday i.e. 27th April. Earlier, on April 20, the Surat Sessions Court had dismissed Rahul Gandhi’s plea to stay his sentence.

Significantly, the trial court in Gujarat’s Surat has convicted Rahul Gandhi in a criminal defamation case filed on March 23 at an election rally on the remark related to the Modi surname. The court sentenced Rahul Gandhi to two years’ imprisonment. Subsequently he was disqualified as a member of the Lok Sabha.

Let us tell you that Congress leader Rahul Gandhi addressed a rally in Karnataka during the 2019 Lok Sabha elections. During this, he gave a statement regarding ‘Modi surname’. BJP MLA Purnesh Modi had filed a defamation case against Rahul regarding his statement. Four years later, on March 23, 2023, the lower court of Surat convicted Rahul Gandhi and sentenced him to two years.

Parliament membership was also canceled

After Rahul Gandhi was convicted, his membership of Parliament was canceled by the Lok Sabha Secretariat under the Representation of the People Act. Rahul Gandhi was the MP from Wayanad in Kerala. Actually, under the Representation of the People Act, if an MP and MLA is punished for two years or more in any case, then their membership is cancelled. Along with this, he is disqualified to contest any election for six years after completing the sentence.
