A hearing is going to be held in the Supreme Court on Tuesday, April 18, regarding same-sex marriage. This hearing is going to be done by a constitutional bench of five judges. An affidavit was earlier filed by the Central Government. In which the Central Government demanded to dismiss all the petitions. Along with this, the central government had said that the court cannot rewrite an entire branch of law by recognizing the right to same-sex marriage. According to the Centre, the creation of a new social custom is outside the purview of judicial determination.

The Central Government had told the Supreme Court that same-sex marriage cannot be recognized with the help of a judicial award. With this, the Central Government said that this right does not come under the purview of the Supreme Court. It comes under the purview of the Parliament. According to the center, the adoption of same-sex marriage reflects an urban elite idea.

The central government says that the option of not recognizing marriages in the same gender is a part of legislative policy. Keeping this legislative policy in view, it is not right for the court to decide this dispute. Further said that marriage can only take place between a man and a woman.

Central Government’s application in the Supreme Court

On April 16, the Central Government filed a petition in the Supreme Court saying that the responsibility of the Parliament regarding same-sex marriage is towards the citizens. This same-sex marriage should be done according to the will of the people, especially when it comes to personal law.
